Overview

Joseph joined Maitland in September 2020, after successfully completing pupillage. He now has a busy and broad commercial chancery practice spanning the whole gamut of Chambers’ practice areas, with an emphasis on civil fraud, commercial, insolvency and property disputes.

Joseph has experience dealing with all stages of dispute resolution, from pre-action and ADR through to trial, appeal, and enforcement. He appears frequently in both the County Court and the High Court, and is happy acting alone, with a leader, or as part of a larger counsel team. Recent examples of his led work include Re Bitumina Industries Ltd [2022] EWHC 2578 (Ch) (an insolvency case concerning the creation and enforceability of floating charges), Macey v Pizza Express (Restaurants) Ltd [2021] EWHC 2847 (Ch); [2022] L. & T.R. 6 (an appeal relating to business tenancy renewal); and Pickle Properties Ltd v Plant (British Virgin Islands) [2021] UKPC 6 (a commercial appeal relating to guarantees). He has also appeared in the High Court (both led and unled) successfully defending urgent interim applications.

 

Joseph read law at Magdalen College, University of Oxford, where he took a double first (along with subject prizes and a Scholarship). He then went straight onto the BPTC (as a Lord Denning Scholar of Lincoln’s Inn), followed immediately by pupillage, becoming a tenant at Maitland aged 23. Alongside his first year of practice, he returned as a Lecturer to Magdalen College, Oxford, to teach the Law of Torts. Outside of practice, he maintains a keen interest in legal history, and is a member of the Selden Society for the promotion of English legal history.

Most recently he has been part of the counsel team dealing with substantial High Court litigation concerning breach of fiduciary duties and its remedial consequences.

  • Pickle Properties Ltd v Plant (British Virgin Islands) [2021] UKPC 6 [2021] All ER (D) 120 (Mar) – Joseph acted (led by Nicholas Peacock KC) for the Respondent, who succeeded before the Privy Council. The appeal concerned the effect of delay on the safety of a judgment, and the circumstances in which an equitable contribution from a co-guarantor will be denied.

Joseph has a keen interest in land law, and came top in his year at Oxford in the subject. He regularly acts in possession proceedings (mortgage, residential, and commercial), recently appearing (led by Richard Fowler) in Macey v Pizza Express (Restaurants) Ltd [2021] EWHC 2847 (Ch); [2022] L. & T.R. 6. He also has experience acting in, and advising on, boundary disputes, commercial disputes concerning real securities, and other interests in land (such as easements).

  • Re Bitumina Industries Ltd [2022] EWHC 2578 (Ch) – Joseph (led by Olivier Kalfon) acted for the Joint Administrators of the company. The case concerned the creation of a floating charge, and its enforceability under Section 245 of the Insolvency Act 1986. It entailed a route and branch consideration of Section 245, its effect, construction, scope and interaction with authorities under the previous insolvency statutes. The judge (at [36] and [122]) praised their submissions, noting the “great deal of benefit” he had derived from their “closely-reasoned analysis”.
