Overview

Richard’s practice is focused on large scale Chancery/commercial litigation and arbitration for international clients, frequently involving freezing orders, other interim relief and jurisdictional issues.  His previous cases have covered aspects of company law, commercial contracts, insolvency, civil fraud, asset tracing and recovery, and conflict of laws, along with broader Chancery/commercial work, including property litigation, partnership, professional negligence, and sports law.

Along with his domestic and offshore practice (principally in the BVI and Cayman), Richard has been instructed in a number of international arbitrations under LCIA, ICC, ICDR and DIFC rules, as well as sitting as an arbitrator on a number of occasions and as an expert for an expert determination in Hong Kong under BVI law.  Richard has also given expert evidence on English law in a case in California, as well as being retained as an expert witness on other occasions

 

Over the years Richard has been instructed in cases in a number of jurisdictions concerning a very wide range business areas for clients from (almost) all over the world.  The subject matter of those cases and the identity of the clients are frequently highly confidential or commercially sensitive.  In the circumstances this page does not set out descriptions of those cases, but his clerks are able to provide some anonymised outline descriptions of matters with which he has been involved in the event that this would be of assistance.

Richard has experience of working with lawyers in a number of other jurisdictions, including Australia, Singapore, the Middle East, Russia, Kazakhstan, Cyprus, USA, Bermuda, and France, as well as the Cayman Islands, the British Virgin Islands, the Isle of Man, the Channel Islands (principally Jersey) and Gibraltar. Richard has appeared in the Cayman Islands, and is called to the Bar of the Eastern Caribbean, appearing in the British Virgin Islands both at first instance and in the Caribbean Court of Appeal, as well as being called ad hoc on occasion in the Isle of Man, Bermuda and in the Supreme Court of Gibraltar. He has contributed to Insolvency Bulletins (as author of ‘International Asset Chasing and Tracing’) and was the author of ‘Litigation Strategies aimed at Swelling Assets’ in Butterworths Practical Insolvency.

Richard has experience sitting as both a special examiner and an arbitrator, has provided an expert determination in a Hong Kong case concerning a BVI company and has given evidence as an expert on English law in a case in California.

    Successful challenge to arbitration award under section 68 of the Arbitration Act 1996 on the grounds that the tribunal had acted unfairly in reaching a decision without the losing party’s main witness being cross-examined on that issue and by basing their decision on a case which had not been argued.
